Vehicle Accident

Provision:
An Officer is guilty of an Offence if they:

  1. Are involved, as the driver, in any vehicular collision, regardless of fault;
  2. Fail to engage the vehicle’s handbrake, resulting in unintentional movement and damage;
  3. Park a vehicle in a manner that results in a member of the public colliding with it;
  4. Require recovery assistance for a vehicle, except in the event of a genuine mechanical failure;
  5. Strike and fatally injure an animal while operating a vehicle.

Aggravating Circumstances:

  • The damage incurred is presumed to result in a total loss claim;
  • Two or more such Offences occur within a single calendar month.

Defence Clause:

  • A valid defense may be raised if the handbrake error occurred while actively engaging a terrorist threat.
