Provision:
An Officer is guilty of an Offence if they:
- Are involved, as the driver, in any vehicular collision, regardless of fault;
- Fail to engage the vehicle’s handbrake, resulting in unintentional movement and damage;
- Park a vehicle in a manner that results in a member of the public colliding with it;
- Require recovery assistance for a vehicle, except in the event of a genuine mechanical failure;
- Strike and fatally injure an animal while operating a vehicle.
Aggravating Circumstances:
- The damage incurred is presumed to result in a total loss claim;
- Two or more such Offences occur within a single calendar month.
Defence Clause:
- A valid defense may be raised if the handbrake error occurred while actively engaging a terrorist threat.
