Provision:
An Officer is guilty of an Offence if they:
- Arrest an individual who is not the intended subject of arrest;
- Arrest a person without lawful authority.
Aggravating Circumstances:
- A formal complaint is submitted by the individual;
- The individual is transported to a holding facility (lock-up).
